The website www.borjaserrano.com is offered for informational purposes in relation to the activity carried out by BS. This website is an online sales channel for art and decoration. The user of the website, by accessing and browsing it, undertakes to use it in accordance with current legislation at all times and the conditions established in this legal notice, morality and generally accepted good customs and public order.
The user will respond to BS and / or to third parties, for any damages that may be caused as a result of the breach of said obligation.

These General Purchase Conditions apply to the sale of all BS items through its website, to consumers to whom orders can be delivered in Spain. BS informs that its website is exclusively aimed at an audience over 18 years of age. BS reserves the right to cancel a client’s access account if fraudulent, speculative or bad faith acts are detected in the use of this service.
As stated above, the use of this page, the contracting of the services that are made available to the user as well as the commercial transactions carried out in our virtual store will imply the full and unreserved acceptance by the user of all and each of the clauses and stipulations that are included in these Conditions of Use and Terms of Sale.
In addition to these Conditions of Use and Terms of Sale, the online sales process in Spain that is carried out through this website will be regulated by the Spanish legislation that is in force at all times.
EXERCISE
The purpose of the BS entity is the retail sale of art. BS reserves the right to modify the commercial offer presented on the website (modifications to products, prices, promotions and other commercial and service conditions) at any time.
Once the order is formalized, which implies in any case the acceptance of these Conditions of Use and Terms of Sale and the confirmation of the purchase, BS will send an email to the user confirming the details of the purchase made.
All the prices of the products indicated through the website include VAT. and the other taxes that may correspond. The applicable prices are those indicated on the website on the date of the order. The prices are detailed in each article and include VAT (Tax on Added Value), IGIC (General Indirect Tax on the Canary Islands), or IPSI (Tax on Production, Services and Import in Ceuta and Melilla), as appropriate. The amount of shipping costs is indicated to the customer in a detailed manner at the time the order is placed.
PAYMENT METHODS
The user agrees to pay for the purchase at the time the order is placed. The ticket or proof of purchase corresponding to the purchase order will be available and can be viewed in the “my account” section under “Orders” on the website. The user must pay the amount corresponding to his order by means of payment by credit or debit card (Visa, Mastercard, American Express, Visa electron and / or other similar cards), or by means of alternative payment systems: Paypal, Apple Pay . The card with which the payment is made must necessarily have a Spanish bank or savings bank as the issuing financial entity.
SHIPPING
BS undertakes to deliver the product in perfect condition to the address indicated by the user in the order form and which, in any case, must be within the peninsula and the Balearic Islands. In order to optimize delivery, we thank the user for indicating an address where the order can be delivered within normal business hours.
The order will be sent to the delivery address that you indicate, as long as it is within Spain (peninsula and Balearic Islands). This may be different from the buyer’s address.
BS will not be responsible for errors caused in delivery when the delivery address entered by the user in the order form does not conform to reality or has been omitted.
The types of delivery contemplated are:
SPAIN / PENINSULA – TIPSA ECONOMY 24 / 48H
Free shipping costs for purchases equal to or greater than € 35 for orders destined for the peninsula or the Balearic Islands, and € 75 for orders destined for Ceuta, Melilla or the Canary Islands. For orders of a lower amount the standard shipping costs of € 4 apply to the peninsula and the Balearic Islands. In the case of Ceuta, Melilla and the Canary Islands, the standard shipping rate is always € 12. The order will be delivered within an approximate period of 24 to 48 hours from the order confirmation.
Shipping costs will depend on the total amount of the purchase and the delivery point. Shipping costs may be assumed by BS if this advantage is specified within a promotion. These shipping cost promotions are usually subject to the purchase of a minimum amount.
Shipments to the Canary Islands, Ceuta and Melilla will be subject to customs and / or import charges in addition to the amount of the order. Canary Islands (approx.) € 18 DUA + 7% IGIC. Ceuta and Melilla (approx.) € 18 DUA + 7% clothing / 10% IPSI footwear. Customers will bear the corresponding customs and / or import expenses.
NO CHANGES OR RETURNS OF ANY KIND ARE ACCEPTED.
When dealing with works of art and considering the possible deterioration that excessive manipulation and exposure to different changes in weather conditions could cause to the work, the option of exchange or return of the work will be denied. To avoid confusion please contact and report the work you wish to purchase.
JURISDICTION
For any discrepancy, difference or disagreement that could not be resolved by agreements reached by the parties, they expressly waive any jurisdiction that may correspond to them and submit to the jurisdiction and competence of the Courts and Tribunals of the city of Seville.
